1. Acceptance of Terms
These Terms govern your use of the Health Nurture Fact website, consultation services, coaching memberships, digital resources and email communications. We may update these Terms; the revised version applies from the posted "Last updated" date.
2. Our Services
Health Nurture Fact provides nutrition education, dietary coaching and wellness programming, including: Nutritional Calorie & Portion Management, Weight Loss & Gain programs, Healthy Eating Coaching, and Gut Health Nutrition. Services are delivered in-person (Columbus, GA) and via telehealth across the USA. Program scope, session frequency and deliverables correspond to the membership tier purchased.
3. Not Medical Advice
All content, plans and coaching are educational and supportive in nature and do not constitute medical advice, diagnosis or treatment. Health Nurture Fact does not replace your physician. You are responsible for informing your doctor of any dietary change and for disclosing all medical conditions and medications during your assessment. In an emergency, call 911.
4. Eligibility
You must be 18 years or older to enroll. Minors may participate only through a parent/guardian account. By enrolling you confirm the health information you provide is accurate and complete to the best of your knowledge.
5. Bookings, Scheduling & No-Shows
Consultation requests are confirmed by our care team within one business day. Sessions may be rescheduled with at least 24 hours' notice. Repeated no-shows or late cancellations (under 24 hours) may forfeit that session without refund.
6. Fees, Payments & Renewals
- Memberships are billed monthly in advance at the tier price displayed at checkout ($89 / $149 / $249 per month).
- Payments are processed securely by our third-party payment processor; we never store card numbers on our servers.
- Memberships renew automatically each month until paused or cancelled.
- Itemized superbills are provided on request for HSA/FSA or insurance reimbursement; reimbursement is not guaranteed.
7. Refunds, Pause & Cancellation
New memberships include a 14-day money-back guarantee from first payment, no questions asked. After day 14, fees are non-refundable for the current billing month, but you may pause (up to 60 days/year) or cancel anytime with 30 days' notice via email or the member portal. Cancellation takes effect at the end of the paid period.
8. No Guarantee of Results
Weight-loss, weight-gain and wellness outcomes vary by individual physiology, adherence and medical history. Testimonials reflect real client experiences but are not a promise of identical results. Your commitment to the program materially affects your outcome.
9. Intellectual Property
All website content, meal frameworks, logos, program names and digital resources are the property of Health Nurture Fact. Clients receive a personal, non-transferable license to use purchased materials for personal use only. Reproduction, resale or public distribution is prohibited.
10. Your Responsibilities & Acceptable Use
- Provide truthful health, allergy and medication information;
- Use the website lawfully — no scraping, spamming, reverse engineering or uploading malicious code;
- Keep account credentials confidential;
- Treat coaches and staff with respect; abusive behavior may result in termination without refund.
11. Email & Newsletter Terms
Newsletter subscription is opt-in. You may unsubscribe via any email link or our unsubscribe page. Form submissions (booking/contact) authorize us to reply to your enquiry; they do not enroll you in marketing emails.
12. Disclaimer of Warranties & Limitation of Liability
The website and services are provided "as is" without warranties of any kind, express or implied. To the maximum extent permitted by law, Health Nurture Fact shall not be liable for indirect, incidental or consequential damages arising from use of the website or services. Nothing in these Terms limits liability that cannot be limited by law.
13. Indemnification
You agree to indemnify and hold Health Nurture Fact harmless from claims arising from your misuse of the website, breach of these Terms, or omission of material health information during your assessment.
14. Governing Law & Disputes
These Terms are governed by the laws of the State of Georgia, USA. Disputes will first be addressed in good-faith negotiation; unresolved disputes fall under the exclusive jurisdiction of the courts of Muscogee County, Georgia.
